Official Rules

OFFICIAL RULES:

1. NO PURCHASE NECESSARY TO ENTER OR WIN. OFFER VOID WHERE PROHIBITED BY LAW.

2. ENTRY REQUIREMENTS: Go to www.dogtime.com/holiday-gift-guide-sweepstakes/, correctly complete the official entry form including all requested information, and submit your entry as directed. This is an Internet-only Sweepstakes. Sweepstakes begins on 11/17/08 at 12:01 AM (PST) and ends at 11:59 PM (PST) on 12/31/08. Sponsors have the sole discretion to determine the valid and official entry time should any discrepancies of time occur. Additionally, Sponsors reserve, in their sole discretion, the right to extend the Sweepstakes Period for whatever reason without notification. Limit one entry per person. Odds of winning depend on number of eligible entries received.

3. ENTRY CONDITIONS: By entering, entrant agrees: (a) To abide by these Sweepstakes rules (exact compliance is essential); (b) To accept as final and binding the decisions of the Sponsors, judge(s) and their agents in all matters relating to this Sweepstakes; (c) That all entries submitted become the property of Sponsors and will not be acknowledged or returned; and (d) To the collection of all information on each entry, and to its transfer to third parties.

4. DRAWING: Two (2) winners will be selected by judges in a random drawing held on or about January 10, 2009 from all eligible entries received. Judges' decisions are final and binding in all matters. Winners will be notified by mail. Winners may not substitute, assign, or transfer prize or redeem prize for cash. Sponsors reserve right to substitute prize with prize of equal or greater value if advertised prize becomes unavailable.

In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the email address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential Winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.

5. Winners will be deemed the subscriber to the Internet account, who must comply with all of these rules. Prize won by a minor may be awarded to parent/legal guardian. Limit of one (1) prize per person/household.

6. ELIGIBILITY: Sweepstakes is subject to all U.S. federal, state and local laws and regulations and is void where prohibited, taxed or restricted by law. To be eligible to win a prize, entries must be completed and received by Sponsors in compliance with these rules and all other instructions of Sponsors. Sweepstakes is open to legal residents age 18 or older of the contiguous 48 United States. Employees of Sponsors and their affiliates, subsidiaries, distributors, retailers and anyone involved with the design, production, execution or distribution of Sponsors' products or related promotional materials and their families are not eligible. Limit one entry per person. No other entries will be accepted.

GENERAL: Prize Winners will be notified by email approximately 14 days after selected. Winners will be required to sign and return an affidavit of eligibility and liability release, and a publicity release, where lawful within 14 days of the post marked date to: DogTime's Ultimate Holiday Gift Guide Sweepstakes, c/o DogTime Media, 27 Maiden Lane, Suite 700, San Francisco, CA 94108, or prize will be forfeited. If prize notification or prize is returned as non-deliverable, prize will be forfeited and no alternate Winner selected. Unclaimed prizes will not be awarded. If an individual winner does not claim his or her prize by February 1, 2009, the prize will be forfeited back to the supplier. Prizes cannot be claimed after the Sweepstakes has been completed or forfeited. Neither the Sponsors nor any of their agencies are responsible for lost, interrupted, or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions, or technical failure, jumbled, scrambled or misdirected transmissions, or other errors of any kind whether human, mechanical or electronic or for phone, electrical, network, computer hardware or software program malfunctions, failures or difficulties, or for ISP/network/Web site accessibility or unavailability. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by the Sponsors, will be disqualified. If disqualified for any tampering or abuses, Sponsors reserve the right to terminate entrant's eligibility to participate in Sweepstakes. In the event any portion of this Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsors which, in the sole opinion of the Sponsors, corrupts, or impairs the administration, security, fairness or proper submission of entries, Sponsors reserve the right at their sole discretion to suspend or terminate the Internet Sweepstakes, and randomly select a Winner from Internet entries received prior to the action taken. All decisions of Sponsors on all matters relating to this promotion are final.

7. GENERAL RELEASE: WINNER BY ACCEPTANCE OF PRIZE AGREES THAT SPONSORS AND THEIR AFFILIATE COMPANIES, PARENTS, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY WINNER AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES RELATED ACTIVITY.

IF WINNER IS A MINOR, WINNER'S PARENTS OR LEGAL GUARDIANS FURTHER AGREE TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY THE UNDERAGED WINNER.

8. USE OF WINNER'S NAME, LIKENESS, Etc.: Except where legally prohibited, Winner grants permission for Sponsors and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes without consent or additional compensation.

9. WINNER'S RESPONSIBILITY: ALL FEDERAL, STATE, AND LOCAL TAXES, LICENSE, TITLE AND/OR REGISTRATION FEES OR OTHERS COSTS, ASSOCIATED WITH WINNING THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. SPONSORS SHALL NOT BE RESPONSIBLE FOR ANY SUCH TAXES, FEES AND COSTS.

Sponsors reserve the right, in their sole discretion, to change these Official Rules at any time without notice. Sponsors reserve the right, in their sole discretion, to disqualify persons whose eligibility is in question or for any other reason whatsoever.
